Judge agrees to pause Jan. 6 case after Trump’s election win

-

(NewsNation) — U.S. District Judge Tanya Chutkan on Friday granted Special counsel Jack Smith’s request to pause any further proceedings in the Jan. 6 case against President-elect Donald Trump.

In a filing from Smith, he asked that the court vacate remaining deadlines in the pretrial schedule “to afford the Government time to assess this unprecedented circumstance and determine the appropriate course going forward consistent with Department of Justice policy.”

Chutkan canceled any remaining court deadlines and ordered prosecutors to file court papers with their “proposed course for this case” by Dec. 2.

Smith said he will give an update to the court on the status of these deliberations by Dec. 2. He charged Trump with felonies accusing him of conspiring to subvert the 2020 election results, as well as illegally hoarding classified documents at his Florida property Mar-a-Lago.

What happens to Trump’s criminal cases now?

Trump has pleaded not guilty.

According to the Associated Press, Trump’s victory over Democratic nominee Vice President Kamala Harris eans that the Justice Department believes he can no longer face prosecution. In July, the Supreme Court ruled that presidents have broad immunity from prosecution.

Meanwhile, the classified documents case has been stalled since July. A federal judge appointed by Trump, Aileen Cannon, dismissed it on grounds that Smith was illegally appointed. Smith then appealed to the Atlanta-based 11th U.S. Circuit Court of Appeals.
